As children across Missouri prepare for a night of trick-or-treating, law enforcement agencies are stepping up their efforts to ensure a safe and fun Halloween for everyone.
The focus is on compliance with state laws regulating registered sex offenders.
This year marks the second year since a change in the law regarding signage requirements for people on Missouri’s sex offender registry.
Free Speech Ruling: No More ‘No Candy’ Signs
In October 2024, U.S. District Judge John Ross issued a ruling in the case of Sanderson v. Bailey, striking down the requirement for those on the sex offender registry to post signs that read “No candy or treats at this residence.”
The judge ruled that this specific provision of Missouri Revised Statute 589.426.1(3) violated the First Amendment’s protection against compelled speech.
Due to the ruling, registered sex offenders in Missouri are no longer required to display “No candy or treats” signs on October 31st.
However, mandatory restrictions remain in effect.
